WA Birth Registration Reforms

Western Australia passed the Births, Deaths and Marriages Registration Amendment (Sex or Gender Changes) Act 2024 (WA) (‘the reforms’), on 26 September 2024. These commenced on 30 May 2025. 

The reforms establish a new administrative process for individuals to update their sex or gender in their birth registration, through the Registry of Births, Deaths and Marriages. These reforms allow for a psychologist to make a statement that a person has received “appropriate clinical treatment regarding their sex or gender” and thus update their sex or gender in their birth registration. There is separate guidance for children and adults. 

The Department of Justice has taken on the feedback of AAPi and created an additional fact sheet around these legislative changes, and enhanced some aspects of the other fact sheets. Please read through these documents to understand the new requirements for Western Australia:
